Published and checked: October 22, 2026. Article: https://canadianjudges.ca/blog/catherine-murray-dulf-kalicum-charter-ruling-source-trail-2026-10-22/

## Scope
Approved backlog item n13, CanadianJudges/JudgeWatch half only. Existing judge ID `bc-sc-catherine-murray` preserved. No NewsForBC changes, private records or outreach. No misconduct implication or finding. No unverified social portrait or third-party photograph reproduced.

## Ruling
R v Kalicum, 2026 BCSC 1855, September 29, 2026, Vancouver docket 36605. Paragraph 257 declares CDSA s 5(2) invalid with general effect suspended six months and separately stays the founders' convictions under Charter s 24(1). Paragraphs 255–256 describe stays of proceedings. Separate trafficking offence s 5(1) is not struck; paragraph 251 rejects limiting the declaration to three drugs. Paragraph 1 records November 7, 2025 findings of guilt held in abeyance pending the constitutional challenge.

## Status and retrieval limits
No notice of appeal, appellate decision or later stay/extension order verified in reviewed official public sources as of October 22. This is NOT proof no appeal exists. No filing-docket search is claimed. Court of Appeal recently posted list contained releases through October 22 and no Kalicum item; PPSC 2026 newsroom contained no Kalicum announcement. Its latest displayed release was July 23. Both pages were read via extraction and direct HTTP; neither is a complete filing docket.

The complete reasons and key paragraphs were preserved in the October 4 research capture. Official-page extraction/search again returned judgment text, but direct HTTP requests to www/non-www HTML and PDF variants returned the court's Judgment Not Found body. A real-browser attempt timed out. No claim that the decision was withdrawn follows from these retrieval failures. Publication relies on the saved court text, fresh available official-page extraction and statute/roster checks, with access limits disclosed.

## Judicial identity
Official roster lists Catherine Murray, Vancouver, appointed October 19, 2016; Justice Canada's announcement is dated October 20, 2016 and identifies her previous Crown Counsel role. Dates are not conflated. Existing profile: https://canadianjudges.ca/judges/bc-sc-catherine-murray/

## Source categories
Written judicial findings are attributed to the judgment. Oral comments and PPSC's initial review position are CBC reporting, not an appeal filing. CBABC commentary is a bar-association statement, not an appeal or disciplinary ruling. The Facebook lead was metadata-only; full post/author/image not authenticated. No raw third-party comment threads are republished.
